Terms and conditions governing access to and use of the SMS Work platform, drafted for users in the European Union and European Economic Area.

1. Trader identification (EU consumer information)

These terms are offered by SMS Work, a provider of business software for OTP phone-number operations.

2. Agreement

By accessing or using SMS Work, you agree to these terms and our Privacy policy. If you use the platform on behalf of an organization, you represent that you have authority to bind that organization. These terms apply in addition to any separate commercial agreement between SMS Work and your organization.

3. Eligibility and accounts

  • You must provide accurate registration information and keep credentials confidential.
  • Organization administrators control signup mode, approvals, pricing, limits, and user roles within their organization.
  • You must be at least 18 years old (or the age of legal capacity in your member state) to create an account.
  • We may suspend or terminate access for policy violations, abuse, non-payment, or security risk, with notice where reasonably practicable.

4. Acceptable use

You agree not to:

  • use the platform for unlawful, fraudulent, or unauthorized OTP interception or resale;
  • attempt to bypass rate limits, access controls, or organization data isolation boundaries;
  • probe, scan, or disrupt upstream providers, APIs, or infrastructure without written authorization;
  • upload malware, interfere with other users, or misuse personal data obtained through the service;
  • infringe telecommunications, data protection, or consumer protection laws applicable in the EU/EEA.

5. Service description

SMS Workprovides tooling for temporary number workflows, SMS ingestion, reporting, and billing. Upstream number availability, carrier quality, and delivery timing depend on third-party providers outside our direct control. Service levels, pricing, and payout rules are defined by your organization's configuration and administrator policy unless otherwise agreed in writing.

6. Fees and billing

Fees, currency, invoicing cycles, and payout thresholds are configured by your organization. Unless stated otherwise, prices exclude applicable VAT or similar indirect taxes, which will be added where required by law. Late payment may result in suspension after reasonable notice.

7. Consumer rights (where applicable)

SMS Work is primarily offered to businesses and professionals (B2B). If you are a consumer within the meaning of EU consumer law, mandatory rights under your national implementation of Directive 2011/83/EU and related legislation remain unaffected by these terms.

For digital services where performance begins immediately at your request, statutory withdrawal rights may not apply once delivery has started with your prior express consent and acknowledgment, as permitted by Article 16 of Directive 2011/83/EU. Business customers acknowledge that enterprise configurations are tailored services.

8. Intellectual property

The platform, branding, and software are owned by SMS Work or its licensors. You retain rights to your operational data subject to these terms and your commercial agreement. Feedback may be used to improve the product without obligation to you.

9. Availability and disclaimer

We use reasonable skill and care to maintain availability but do not guarantee uninterrupted or error-free operation. Except where mandatory EU consumer law provides otherwise, the service is provided on an "as is" and "as available" basis. Implied warranties of satisfactory quality or fitness for a particular purpose are excluded to the fullest extent permitted by applicable law.

10. Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable EU or national law.

Subject to the above, our aggregate liability arising from or related to the service in any twelve-month period is limited to the fees paid by your organization for the service in that period, except where a higher mandatory minimum applies under law.

11. Governing law and jurisdiction

These terms are governed by the laws of Ireland, without regard to conflict-of-law rules. Courts in Ireland have non-exclusive jurisdiction, except where mandatory consumer protection rules in your country of residence require disputes to be brought in your local courts.

12. Online dispute resolution

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board unless required by applicable law or we expressly agree in writing.

13. Changes

We may update these terms by publishing a revised version on this page. Material changes will be notified where required by law or your commercial agreement. Continued use after the effective date constitutes acceptance of the revised terms for business users, subject to mandatory consumer rights.
